USCIS has issued revised guidelines for Prosecutorial Discretion and the Issuance of Notices to Appear (NTAs). The Policy Memorandum, dated November 7, 2011, supercedes Policy Memorandum No. 110, Disposition of Cases Involving Removable Aliens, dated July 11, 2006, and identifies circumstances under which USCIS will issue an NTA or will refer a case to U.S. Immigration and Customs Enforcement (ICE) for NTA issuance.
